What off the plan apartments in Baulkham Hills actually involves

We read the NSW Government's page Buying property off the plan on 7 October 2026. It says properties can be advertised and sold before a building is built or land subdivided, which is called 'buying off the plan', and the Office of the Registrar General's item of 11 October 2019 defines an off-the-plan contract as a contract for the sale of a residential lot that has not been created at the time the contract is entered into. Four pages here follow the contract in order: the cooling off period, sunset clauses, the disclosure statement and changes, and deposits and expressions of interest.

What the page warns about

The NSW Government's page says prices are locked in at the date you exchange contracts, that changes to the building plans often occur during construction, and that the finished complex or unit may not be the same as in the original plan. It says you must review the contract and get legal advice to understand exactly what you are buying. We are not a legal practitioner and we do not say what any contract means.

Apartment buildings and what covers them

The page says the Home Building Compensation scheme covers multi-unit residential buildings up to 3 storeys high and that there is no cover for multi-unit buildings that are more than 3 storeys high. It also says the NSW Building Commission has powers to investigate serious defects in multi-storey residential apartment buildings (class 2). The cover and defects page sets out both. These are State-wide rules, so nothing in them is particular to Baulkham Hills. How long is the cooling off period on an off the plan contract?

The NSW Government says off the plan buyers have a 10 business day cooling off period, longer than the usual 5 business days for an already constructed home, and that a purchaser who pulls out in it forfeits part of the purchase price, an amount its page states.

Can a developer end an off the plan contract?

The NSW Government says off the plan contracts commonly include a sunset clause, and that developers need a buyer's consent, or must apply to the NSW Supreme Court, before they end a contract using one. It says other provisions that let a developer end a contract are not sunset clauses and that each contract is different.
